1. Introduction
Welcome to BrandCraft Studio ("we", "our", or "us"). By accessing or using our website, brandcraftstudio.shop, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use our website.
2. Our Services
BrandCraft Studio provides custom printing, personalised gifts, graphic design services, and related products. All products are subject to availability.
3. Orders
- All orders are subject to acceptance and availability.
- We reserve the right to refuse or cancel any order where necessary.
- Once production has started on a personalised product, the order cannot be cancelled except where required by South African law.
- Customers are responsible for ensuring that all names, wording, colours, artwork, sizes, and other customisation details submitted are accurate before approving production.
4. Pricing
- All prices are displayed in South African Rand (ZAR).
- Prices may change without notice.
- Promotional prices are valid only during the advertised promotional period.
- We reserve the right to correct pricing errors before processing an order.
5. Payments
We accept the payment methods displayed during checkout.
Orders will only enter production once full payment has been successfully received unless otherwise agreed in writing.
6. Personalised Products
Due to the custom nature of our products:
- Personalised products cannot be returned or exchanged simply because the customer changes their mind.
- Customers remain responsible for checking all spelling, grammar, images, colours, and design details before approving production.
- BrandCraft Studio will gladly replace or refund products where:
- We supplied the incorrect item;
- The item is defective;
- The item was damaged before delivery; or
- The mistake was caused by BrandCraft Studio.
7. Production Times
Production times vary depending on the product ordered.
Estimated production times are provided as a guideline only and may change during busy periods.
8. Shipping & Delivery
- Delivery times are estimates and are not guaranteed.
- Delivery delays caused by courier companies, weather, public holidays, strikes, or other circumstances beyond our control are not the responsibility of BrandCraft Studio.
- Risk in the goods passes to the customer upon successful delivery.
9. Customer Artwork
By submitting logos, artwork, photographs, or other content, you confirm that:
- You own the rights to use the content; or
- You have permission from the copyright owner.
BrandCraft Studio accepts no liability for copyright infringement arising from customer-supplied material.
10. Intellectual Property
All BrandCraft Studio logos, branding, website content, graphics, photographs, and designs remain our intellectual property unless otherwise agreed in writing.
No content may be copied, reproduced, distributed, or used without our written permission.
11. Limitation of Liability
To the maximum extent permitted by South African law, BrandCraft Studio shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our website or products.
Our total liability shall not exceed the amount paid by the customer for the relevant order.
Nothing in these Terms limits any rights that customers have under the Consumer Protection Act.
12. Privacy
Your personal information is processed in accordance with our Privacy Policy and applicable South African privacy legislation, including POPIA.
13. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any disputes shall be resolved in accordance with South African law.
14. Changes to these Terms
BrandCraft Studio reserves the right to amend these Terms & Conditions at any time.
Updated versions will be published on our website.
